Q14. I was injured due to a workplace accident: if I make a claim can my employer dismiss me?

A14. Your employer has no legal justification for doing so as it will be viewed as unfair dismissal. However this cannot be guaranteed.

Plus your employer has a responsibility to protect you and other employees against the risk of an injury and there are Health and Safety regulations which have been designed for this purpose.

Your employer must also have taken out insurance to protect his/her employees against the risk of an accident.

But a failure to do so increase the risk of an accident which means that he/she is liable.
